Welcome to Bill Lohsen Plumbing and Heating (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, as well as any plumbing, heating, installation, maintenance, or repair services we provide (collectively, the “Services”).

By accessing our website, scheduling an appointment, or authorizing work, you (“Client,” “Customer,” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or Services.

1. Scope of Services & Estimates

  • Service Requests: All appointments and service calls are scheduled subject to availability.

  • Estimates & Quotes: Any verbal or written estimate is an approximation of expected costs based on initial information and visual inspection. If unforeseen conditions arise (such as hidden pipe damage, outdated wiring, code violations, or structural obstructions), we will notify you before proceeding with additional billable work whenever reasonably possible.

  • Work Authorization: By scheduling a technician or approving an estimate, you authorize Bill Lohsen Plumbing and Heating to furnish the necessary labor, materials, and equipment to complete the agreed-upon scope of work.

2. Access, Site Conditions & Safety

  • Premises Access: You agree to provide our technicians with safe, clear, and uninterrupted access to the work area, utility shut-off valves, electrical panels, and relevant plumbing/heating equipment during scheduled service windows.

  • Existing Pre-Existing Conditions: We are not responsible for damage caused by pre-existing defects, deteriorated or brittle piping, outdated fixtures, unpermitted construction, or prior substandard workmanship discovered while performing Services.

  • Safety & Hazards: The property must be free from recognized health and safety hazards (including exposed asbestos, excessive mold, unsecured animals, or structural instability). We reserve the right to suspend or refuse service if conditions present a hazard to our personnel.

3. Pricing, Invoicing & Payment Terms

  • Payment Due Date: Payment is due upon completion of the service, presentation of the invoice, or according to specific contract terms agreed to in writing.

  • Accepted Payment Methods: We accept [Credit/Debit Cards, Checks, Bank Transfers, Cash, or online invoice payments].

  • Late Payments: Outstanding balances past the due date may be subject to a late charge of [1.5% per month, or the maximum rate permitted by law].

  • Collections & Legal Fees: In the event of non-payment, the Customer agrees to pay all collection agency fees, court costs, and reasonable attorney fees incurred by Bill Lohsen Plumbing and Heating in recovering delinquent balances.

  • Emergency & After-Hours Fees: Services requested outside of regular business hours, during weekends, or on holidays may be billed at an emergency/overtime rate, as disclosed prior to dispatch.

4. Cancellations and Rescheduling

  • We request that any cancellations or rescheduling requests be made at least [24 hours] in advance.

  • Cancellations made after a technician has been dispatched, or situations where a technician arrives and is unable to gain access, may be subject to a standard dispatch or trip diagnostic fee.

5. Warranties & Limitations

  • Workmanship Warranty: We stand behind the quality of our labor. Unless otherwise specified in writing, our workmanship is warrantied for a period of [30 / 90 / 365 days] from the date of completion. This warranty covers labor directly performed by our technicians.

  • Manufacturer Warranties: Materials, parts, fixtures, water heaters, boilers, and appliances installed by us are covered solely by the respective manufacturer’s warranty. We do not extend or alter manufacturer warranties.

  • Warranty Exclusions: Workmanship warranties are void if:

    • The equipment or installation has been altered, serviced, or repaired by unauthorized third parties.

    • Damage results from freezing temperatures, power surges, abnormal water pressure, hard water buildup, neglect, or misuse.

    • Drain clearing: We do not guarantee drain clearing against recurring clogs caused by root intrusion, broken/collapsed lines, foreign objects, or improper disposal practices.

6. Limitation of Liability

  • To the fullest extent permitted by law, Bill Lohsen Plumbing and Heating shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including, but not limited to, loss of use, water damage, business interruption, or personal property damage) resulting from the use of our Services or website.

  • Our total aggregate liability arising out of or related to any service performed shall not exceed the total amount paid by the Customer for that specific service call or project.

7. Intellectual Property & Website Use

  • All content on our website (including text, graphics, logos, photos, and page layouts) is the property of Bill Lohsen Plumbing and Heating and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Governing Law & Dispute Resolution

  • These Terms and any dispute arising from our Services shall be governed by and construed in accordance with the laws of the State of [Insert State, e.g., Vermont / New York], without regard to conflict of law principles.
